Introduction

PunchUp Technologies Inc. (“PunchUp,” “we,” “us,” and “our”) provides this Privacy Policy (the “Policy”) to explain how we collect, use, and disclose your information. This Policy applies to the information collected on or through our online services, including through our website at punchup.live and other websites on which we post this Policy (collectively, the “Services”). It does not apply to information collected or obtained by other means, including without limitation information collected offline. This Policy also does not apply to the privacy practices of Entertainers.


By using or otherwise accessing our Services, you agree to the terms of this Policy. If you do not agree to this Privacy Policy, please do not access or use the Services or provide us with information.

Undefined capitalized terms shall have the definitions as set forth in our Terms of Service. 

What Information Does PunchUp Collect?

We collect information directly from you, automatically through your use of the Services, and from affiliates and non-affiliated parties. Please note that we need certain types of information to provide the Services to you. If you do not provide us with such information, or if you ask us to delete that information, you may no longer be able to access or use certain aspects of the Services.

Information You Provide to Us Directly

We collect information from you directly, such as when you:


  • Access or use our Services;
  • Communicate with us, such as when you inquire about our Entertainers or make inquiries about the services we make available to Entertainers
  • Register for the Services, including when you register as a Fan of specific Entertainers;
  • Subscribe to newsletters or updates;
  • Engage in transactions with us, such as purchase tickets to shows of Entertainers.

The information you provide directly to us may concern you and others and may include, but is not limited to:


  • Identifiers and Other Account Information: You may create an Account to use our Services as an Entertainer and/or Fan. When you create a PunchUp Account, you may be asked to provide certain identifiers and related information, such as your name, email address, zip code, and password.
  • Business Information: If you are an Entertainer, you may provide us with additional information about your business, such as shows you’ve performed.
  • Financial Information: If you purchase subscriptions or other offerings through the Services, our payment processing vendors may collect payment information.
  • Transaction Information: We may collect information about transactions you’ve made with us, such as Entertainers you’ve subscribed to, tickets for shows, fees for providing and managing Entertainer-specific sites, and other purchases.
  • Communications: We may collect your communications with us, such as when you submit questions, communicate with our customer support, or otherwise make inquiries through the Services.

You are not required to provide us with such information, but certain features of the Services may not be accessible or available, absent the provision of the requested information.

Information We Collect Automatically

Device/Usage Information. We and our vendors, which include ad networks and analytics companies such as Google Analytics, may use cookies, web beacons, and other tracking technologies to collect information about the computers or devices (including mobile devices) you use to access the Services. As described further below, we may collect and analyze information including but not limited to (a) browser type; (b) ISP or operating system; (c) domain name; (d) access time; (e) referring or exit pages; (f) page views; (g) IP address; (h) unique device identifiers (e.g. IDFA or Android ID); (i) version of our Services you’re using; and (j) the type of device that you use. We may also track when and how frequently you access or use the Services, including how you engage with or navigate our website or mobile application. We use this information (including the information collected by our vendors) for analytics (including to determine which portions of the Services are used most frequently and what our users like/do not like), to evaluate the success of our advertising campaigns, and as otherwise described in this Policy.


Cookies and Other Electronic Technologies. We and our vendors may use cookies, clear GIFs, pixel tags, and other technologies that help us better understand user behavior, personalize preferences, perform research and analytics, and improve the Services. These technologies, for example, may allow us to tailor the Services to your needs, save your password in password-protected areas, track the pages you visit, help us manage content, and compile statistics about usage of our Services. We or our vendors also may use certain of these technologies in emails to our customers to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.


You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but your browser may allow you to modify your browser settings to decline cookies if you prefer. If you disable cookies, you may be prevented from taking full advantage of the Services, because the Services may not function properly. As we adopt additional technologies, we may also gather additional information through other methods.


Location Information. When you use the Services, we may collect general location information (such as general location inferred from an IP address).

Information From Affiliates and Third Parties

We may collect information about you or others through our affiliates or through non-affiliated parties. For example, Fans may refer friends or other Fans to the Services. We may also receive information about you from third parties such as data or marketing partners.


We may combine information that we collect from you through the Services with information that we obtain from such other parties and information derived from other products or Services we provide.

How Does PunchUp Use the Information We Collect?

We use the information we collect for business and commercial purposes, such as:


  • To provide, maintain, improve, and enhance the Services;
  • To manage and Entertainer websites, including to facilitate communications between Fans and Entertainers;
  • To communicate with you, including to provide you with updates and other information related to the Services, provide information that you request, respond to comments and questions, and otherwise provide support;
  • To understand and analyze how you use the Services and develop new products, services, and features;
  • To process transactions, such as if you are a Fan who subscribes to an Entertainer, or if you make a purchase on or through the Services;
  • To investigate and prevent fraud, and respond to trust and safety issues that may arise;
  • To comply with our legal obligations or as permitted by law;
  • To protect the safety and/or integrity of our users, employees, other parties, members of the public, and/or the Services;
  • For marketing purposes;
  • For analytics purposes;
  • For compliance purposes, including enforcing our Terms of Service and other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and
  • For any other purpose for which we provide notice to you.

We may aggregate and/or de-identify information collected through the Services. We may use de-identified or aggregated data for any purpose, including without limitation for research and marketing purposes and may also disclose such data to other parties, including without limitation, advertisers, promotional partners, sponsors, event promoters, and/or others.

When Does PunchUp Disclose the Information We Collect?

We may disclose the information we collect in the following circumstances:


  • Affiliates. We may disclose information to our subsidiaries or other affiliates.
  • Vendors. We may disclose information to vendors who perform services on our behalf. They provide a variety of services to us, including data storage, analytics, billing, marketing, product content and features, customer service, data storage, security, fraud prevention, and legal services.
  • Safety and Protection of PunchUp and Others. We may disclose certain information if we believe in good faith that doing so is necessary or appropriate to (i) protect or defend the rights, safety, or property of PunchUp or other parties, including to defend or enforce this Policy, our Terms of Service, or any other contractual arrangement or (ii) respond to your requests for customer service; and/or (iii) protect the rights, property or personal safety of PunchUp, its agents and affiliates, its employees, Entertainers, Fans, and other users, and/or the public.
  • Legal Requirements. We may disclose certain information if we believe in good faith that doing so is necessary or appropriate to comply with any law enforcement, legal, or regulatory process, such as to respond to a warrant, subpoena, court order, or other applicable laws and regulations.
  • Business Transfers. We may share or disclose certain information, in connection with or during negotiations or closing of any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Consent/At Your Direction. We may disclose your information to nonaffiliated third parties based on your consent to do so.

Online Analytics

Online Analytics

We may use third-party web analytics services on the Services, such as those of Google Analytics. These vendors use the sort of technology described in the “Information we collect automatically” section above to help us analyze how users use the Services, including by noting the third-party website from which you arrive. The information collected by the technology will be disclosed to or collected directly by these vendors, who use the information to evaluate your use of the Services. We also use Google Analytics for certain purposes related to advertising, as described in the following section. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-Out Browser Add-on.

Tailored Advertising

We may also allow third-party advertising technologies to place cookies or other tracking technologies on your computer, mobile phone, or other device to collect information about your use of the Services in order to (a) inform, optimize, and serve marketing content based on past visits to our websites and other sites and (b) report how our marketing content impressions and interactions with these marketing impressions are related to visits to our websites. We also allow other unaffiliated parties (e.g., ad networks and ad servers such as Google Analytics) to serve tailored marketing to you and to access their own cookies or other tracking technologies on your computer, mobile phone, or other device you use to access the Services. Those parties that use these technologies may offer you a way to opt out of targeted advertising as described below. You may receive tailored advertising on your computer through a web browser. Cookies may be associated with de-identified data linked to or derived from data you voluntarily have submitted to us (e.g., your email address) that we may disclose to a vendor in hashed, non-human-readable form.

If you are interested in more information about tailored browser advertising and how you can generally control cookies from being put on your computer to deliver tailored marketing, you may visit the Network Advertising Initiative's (“NAI”) Consumer Opt-Out Link, the Digital Advertising Alliance's (“DAA”) Consumer Opt-Out Link, and/or the European Interactive Digital Advertising Alliance to opt-out of receiving tailored advertising from companies that participate in those programs. To opt out of Google Analytics for Display Advertising or customize Google Display Network ads, you can visit the Google Ads Settings page. Please note that to the extent advertising technology is integrated into the Services, you may still receive advertising content even if you opt out of tailored advertising. In that case, the advertising content may not be tailored to your interests. Also, we do not control any of the above opt-out links and are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. If your browsers are configured to reject cookies when you visit these opt-out pages, or you subsequently erase your cookies, use a different computer or change web browsers, your opt-out may no longer be effective.

Your Privacy Choices

We provide you with certain choices regarding your information, such as:


  • Account Information: You can update certain of your account information by accessing your Account.
  • Marketing Emails: You may opt out of receiving marketing communications by clicking on the “unsubscribe” link located at the bottom of, or by following other relevant instructions in, marketing emails you receive from us. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt out of receiving marketing emails, we may still send you emails about services you have requested or received from us.
  • Cookies and Analytics: You can opt out of certain cookie-related and analytics processing by following the instructions in this Policy.

Links to Third-Party Sites and Services

The Services may contain links to sites and services provided by other parties. We do not control those websites or services, and are not responsible for their conduct. These websites are governed by their own policies regarding privacy and security, not by this Policy. We encourage you to review the privacy policies of every website you visit before providing them with any of your information.

Security

We have implemented procedures to safeguard and secure the information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. No security measures, however, are perfect. Therefore, we do not promise and cannot guarantee, and thus you should not expect, that your personal information or communications will not be collected, disclosed and/or used by others.

Children’s Privacy

Our services are not designed or meant for children. We do not knowingly collect personal information from children under 18. If we discover that an individual under 18 has provided us with personal information, we will delete that personal information to the extent required by the Children's Online Privacy Protection Act.

Consent to Transfer

We may store and process data in the United States and other countries outside the United States which may have data protection laws that differ from the laws in your country. By using the Services, or providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the United States and other applicable countries in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where you reside and/or are a citizen.

California Do-Not-Track Disclosure

We do not respond to browser-initiated Do Not Track signals, as the Internet industry is currently still working on Do Not Track standards, implementations, and solutions.

California Shine-the-Light Disclosure

Under California’s “Shine the Light” law, California residents may request certain information regarding our disclosure of your information to third parties for their direct marketing purposes. We may disclose information about you to Entertainers if you subscribe or otherwise register for updates to any Entertainers.

Changes to this Policy

We reserve the right to change this Policy at any time. If we decide to change this Policy, we will post those changes on this page and update the date at the top of the page. The changes will be effective when posted. Please check this page on a regular basis so that you remain aware of what information we collect and how we use it.
